Special POCSO (Protection of Children from Sexual Offences) Judge Shubhrangshu Dhar sentenced Mobinchan Marak to 20 years in jail for the offence he committed on June 6, 2019, according to the victim’s lawyer, Sanjay Sarma.
For raping a youngster, a special court in Assam’s Goalpara district sentenced the man to 20 years in jail.
The accused was found guilty
A rape complaint has been filed against accused Mobinchan Marak for raping a 6-year-old child on June 6, 2019, according to the victim’s attorney. The accused was found guilty of rape under section 376 of the Indian Penal Code and penetrative sexual assault under section 4 of the POCSO Act by the special court.
Section 376 Indian Penal Code
Whoever, except in the cases provided for in subsection (2), commits rape, shall be punished with rigorous imprisonment of either description for a term which shall not be less than seven years, but which may extend to imprisonment for life, and shall also be liable to fine.
Section 4 of the POCSO Act.
Whoever commits a penetrative sexual assault shall be punished with imprisonment of either description for a term which shall not be less than 2[ten years] but which may extend to imprisonment for life, and shall also be liable to fine.
Whoever commits penetrative sexual assault on a child below sixteen years of age shall be punished with imprisonment for a term which shall not be less than twenty years, but which may extend to imprisonment for life, which shall mean imprisonment for the remainder of the life of that person, and shall also be liable to fine.
The fine imposed under subsection (1) shall be just and reasonable and paid to the victim to meet the medical expenses and rehabilitation of such victim
