A girl from Mumbai files a fake rape complaint to make police arrest her brother. He spent two years in jail, says reports.
After two years, when court was done with all the charges against the brother, he was finally released from the jail. Sources said, the girl had decided to file a complaint against him after he assaulted her for meeting her boyfriend.

A court in Dindoshi passed the order to release the 24-year-old last week and discharged him of rape. The charges levelled against the man were also lifted by the court under the Act – Protection of Children from Sexual Offences (POCSO).
Girl talks about filing false complaint to the court
During the trial of the case, the girl told the court about the false complaint against her brother. The deposition of the two witnesses were carefully heard by the court and the investigating officer of the case. The statement by the girl revealed that she had filed a fake complaint against her brother after he scolded her for going out with her boyfriend.
Denied sexual assault allegations
The girl said her medical examination was not conducted at the hospital after launching the FIR and denied sexual assault allegations. The court in response to the arguments said,they don’t have any evidence to prove that the girl was a minor in 2018,when the incident happened, according to reports by The Indian Express.
Observations made by court
The court also made an observation about the testimony of the girl which consists of contradictions and omissions.
It observed,”PW 1 (girl) might not have supported the prosecution case because of the intense relationship between the victim girl and the accused… She has resigned from her own statement so I am constrained to hold that because of the contradictory, unbelievable testimony of the victim and insufficient evidence, the offence… have not been proved against the accused. “
