Raj Kundra has been involved in filming and producing pornographic content using his former company and through his app HotShots. He was arrested last month on the previously mentioned charges.
Previously, he had challenged the remand order a magistrate’s court issued against him, accusing them of not notifying him before his detention, which is a requirement under the Code of Criminal Procedure.
However, the High Court order says that there was nothing wrong with the magistrate court’s order when they took Raj Kundra to police custody on July 20.
Thus, the High Court rejected his plea as Justice AS Gadkari said that his remand by the magistrate and judicial custody were within the conformity of the law and did not require any sort of interference.
Kundra refuses arrest despite prior notice from police
According to the police, they had issued a notice prior to his arrest despite that Kundra refused to comply with them.
Therefore, the police argue that the refusal of Raj Kundra is an implication of the petitioner’s refusal to co-operate.
Moreover, Raj Kundra and his fellow associates have deleted messages from a Whatsapp group while the police were collecting evidence with regard to the case. This is the destruction of evidence and can be added to their charges.
Argues that the contents of his “film” are not pornography
Businessman Raj Kundra and his friend Ryan Thorpe were detained on July 19 for their roles in the creation of pornography. The former argues that the content is not pornography, and there are other similar contents on OTT platforms.
Mr Kundra and Mr Thorpe are in judicial custody now despite Mr Kundra’s several applications for bail since his arrest.
