Arvind Kejriwal Released as Supreme Court Upholds Liberty

In a significant ruling, the Supreme Court on Friday granted bail to Delhi Chief Minister Arvind Kejriwal in connection with the alleged excise policy corruption case. The Central Bureau of Investigation (CBI) had charged Arvind Kejriwal with irregularities in the now-scrapped Delhi excise policy for 2021-22. The court, in its verdict, emphasized that “prolonged incarceration amounts to unjust deprivation of liberty,” signaling a major relief for the Aam Aadmi Party (AAP) leader.

The decision came just days after the court reserved its judgment following a comprehensive hearing of arguments presented by Arvind Kejriwal’s defense team and the CBI. This ruling marks a pivotal moment in the months-long legal battle that has garnered nationwide attention.

CBI’s Objection to Kejriwal’s Legal Maneuvering Rejected

During the proceedings, the CBI, represented by Additional Solicitor General SV Raju, argued against Arvind Kejriwal’s approach to bypass the trial court. The prosecution raised concerns that Kejriwal had directly moved to the Delhi High Court for bail and subsequently escalated the matter to the Supreme Court without first seeking relief from the lower courts.

The Supreme Court, however, did not uphold the CBI’s objections, stating that Arvind Kejriwal’s legal strategy did not violate due process. In its ruling, the court reiterated that personal liberty should not be compromised unnecessarily, particularly when prolonged detention was at issue.

Delhi High Court’s Initial Ruling and CBI’s Claims

Before the Supreme Court granted bail, Arvind Kejriwal’s arrest had been validated by the Delhi High Court on August 5, 2024. In that judgment, the High Court upheld the legality of Kejriwal’s arrest, dismissing his plea to challenge the CBI’s actions. The High Court’s decision was largely based on the premise that the CBI had collected sufficient evidence before proceeding with the arrest and had acquired the necessary sanctions from the authorities in April 2024.

The High Court emphasized that Kejriwal could exert significant influence over witnesses in the case. The court noted that several witnesses had come forward only after Kejriwal was arrested, adding weight to the argument that his presence could potentially impact the course of the investigation.

Arrest Timeline: AAP Leader in Legal Crosshairs

Arvind Kejriwal’s troubles began on March 21, 2024, when he was arrested by the Enforcement Directorate (ED) in a related money laundering case. The ED was investigating allegations of financial irregularities tied to the Delhi excise policy, which had been scrapped after concerns over possible corruption surfaced. While in ED custody, Kejriwal was further arrested by the CBI on June 26, 2024, in connection with the excise policy case.

The allegations leveled against Arvind Kejriwal and his government have been hotly contested, with the AAP leader consistently denying any wrongdoing. According to the CBI, Kejriwal and other officials manipulated the 2021-22 excise policy to benefit private liquor vendors and to facilitate the laundering of money.

AAP Hails Court Ruling as ‘Victory of Truth’

Following the Supreme Court’s decision to grant bail, leaders of the Aam Aadmi Party were quick to celebrate the development. Prominent AAP figure Manish Sisodia took to social media platform X (formerly Twitter), stating, “Today once again truth has won in the fight against lies and conspiracies.” Sisodia also praised the judicial system and lauded Baba Saheb Ambedkar for safeguarding individual liberties in India’s democratic framework.

Sisodia’s remarks echoed the sentiments of AAP members, who have consistently accused the opposition of using investigative agencies to suppress political dissent. The AAP has maintained that the charges against Arvind Kejriwal were politically motivated and designed to derail his political career.

Opposition Continues to Press Charges of Corruption

Despite the court’s decision, the opposition, including the Bharatiya Janata Party (BJP), continues to press for further investigation into Kejriwal’s alleged involvement in the excise policy scandal. They argue that the bail ruling does not equate to an exoneration and that the legal process should continue without interference.

Opposition leaders have pointed to the Delhi High Court’s findings, which suggested that Kejriwal held significant influence over key witnesses in the case. They argue that this influence could jeopardize the integrity of the investigation and have called for stricter oversight as the case moves forward.

The Excise Policy Controversy

The excise policy in question was introduced by the Delhi government in 2021 with the goal of reforming the capital’s liquor distribution system. However, the policy quickly came under scrutiny after allegations of favoritism and corruption emerged. Critics claimed that private liquor vendors had been unduly favored in the new policy framework, and that Kejriwal’s administration may have benefitted financially from the deal.

The Delhi government eventually scrapped the policy, but by that point, the damage had been done. Investigations by both the ED and CBI were launched, culminating in Kejriwal’s arrests earlier this year. The case has become one of the most high-profile political scandals in recent memory.

What’s Next for Kejriwal?

With bail now secured, Kejriwal is expected to return to his duties as Chief Minister while continuing to fight the corruption charges. His legal team has expressed optimism that the case will be resolved in his favor, citing a lack of concrete evidence to support the allegations against him.

However, the road ahead remains uncertain. As the CBI and ED continue their investigations, and with the opposition relentlessly pursuing the case, the political landscape in Delhi may remain turbulent in the coming months.

A Temporary Reprieve for Kejriwal

While the Supreme Court’s decision to grant bail offers temporary reprieve to Kejriwal, the larger legal battle is far from over. As the case continues to unfold, the Delhi Chief Minister must navigate both the legal and political challenges posed by the excise policy scandal. For now, his release is seen as a symbolic victory for AAP, but the ultimate outcome remains to be seen.
