Assam Police: In a major political development, the Assam Police have registered an FIR against Congress MP Rahul Gandhi for his contentious remarks accusing the Bharatiya Janata Party (BJP) and Rashtriya Swayamsevak Sangh (RSS) of “capturing every single institution in the country.” The FIR, filed at Guwahati’s Pan Bazar police station, accuses Gandhi of actions that “endanger the sovereignty, unity, and integrity of India.”

The case has been registered under Sections 152 and 197(1)d of the new penal code BNS, marking it as a cognisable and non-bailable offence. The complaint, filed by Monjit Chetia, a resident of Guwahati, states that Gandhi’s remarks during the inauguration of Congress’s new headquarters in Delhi on January 15 crossed the limits of permissible free speech and posed significant threats to public order and national security.

According to the FIR of the Assam police, Rahul Gandhi’s statement, particularly the phrase “we are now up against the Indian state itself,” was deemed inflammatory. The complainant alleged that these words incite rebellion and subversive activities among the populace, further attempting to delegitimise the Indian state. Chetia attributed these remarks to Gandhi’s frustration over the Congress party’s electoral setbacks in recent years.

Statements Sparking Controversy

During the inauguration event, Gandhi launched a scathing criticism of the BJP and RSS, accusing them of systematically dismantling India’s democratic institutions. He remarked, “Do not think we are fighting a fair fight… They have captured almost every institution in our country. We are now up against the Indian state itself.”

The complainant has argued that as the Leader of the Opposition, Rahul Gandhi holds the responsibility to uphold public trust in democratic processes. Instead, the complaint alleges, he misused his position to “spread falsehoods and provoke rebellion,” thereby threatening national unity and sovereignty.

Political Reactions and Public Debate

The FIR that has been filed by the Assam police sparked a new wave of political tensions, with Congress leaders defending Gandhi’s remarks as an expression of democratic dissent. Congress spokespersons argued that the statement was aimed at highlighting the challenges faced by opposition parties in the current political landscape, rather than an attack on the sovereignty of India.

Meanwhile, BJP leaders welcomed the FIR, accusing Gandhi of consistently making anti-national statements and undermining the nation’s democratic fabric. Assam’s ruling party leaders have praised the swift action taken by the state police, emphasizing the need to maintain public order and national integrity.

This development raises important questions about the limits of free speech in India, particularly when statements made by political leaders are interpreted as a threat to national security.
