WHAT DID HIGH COURT SAY
As The Gauhati High Court a week ago allowed the Assam Public Service Commission to hold the combined competitive exam (Mains), 2020 without the language papers.
However, the commission has been directed not to hold the final selection of candidates without the court’s permission. Advocate Pankaj Pratim Borah said, “The court has directed the APSC to hold the exam without the language paper. It stated that the final selection of the candidates shall be subjected to the outcome of the petitions”
The high court heard a PIL filed by Siddhartha Sarmah and three writ petitions separately filed by Navin Kumar Ray, Bonani Priya Rajkonwar and Bondita Borah.
Earlier in December last year, the court had passed two consecutive orders in this matter. On December 10, 2020 the court was hearing the writ petitions challenging the APSC CCE rules, which had made the qualifying language paper mandatory exempting in a few of the districts. It directed the commission to hold the CCE (Mains) exam, 2020 without the language paper.
A week later, the court heard the PIL filed by Siddhartha Sarmah, which challenged the state government’s decision and seeked a direction to the respondent authorities to strictly follow the Assam Official Language Act, 1960. It moreover asked the Assam Public Service Commission (APSC) not to hold the exam without the permission of the court.
